POSITION DESCRIPTION:

Under the general direction of the Administration Division leadership, the Compliance Director (CD) will assume full management responsibility for the following units: Regulatory Affairs & Audits; Administrative Hearings; and the Office of Civil Rights. This director-level role is responsible for shaping and executing agency-wide compliance policies, goals, and objectives.

The CD brings together all the agency sections working to implement Civil Rights and Equity programs, which includes Title VI/Equal Employment Opportunity (EEO), Investigations, Ombuds, Small Business, the Office of Racial Equity & Belonging (OREB), Accessible Services. The CD leads the team in these areas overseeing compliance with various regulatory requirements.

EXAMPLES AND IMPORTANT AND ESSENTIAL DUTIES:

  • Manages the development and implementation of departmental goals, objectives, policies and priorities for Civil Rights, Equity, Regulatory programs and the ongoing improvement and development of these programs.
  • Manages departmental compliance activities including equal employment opportunity compliance, small, disadvantaged business programs, contract compliance, Title VI, and language access compliance; recommends and administers policies and procedures.
  • Manages internal grievances and external complaints regarding potential discrimination, harassment and retaliation; directs the conduct of complaint investigations, audits and administrative hearings; reviews reports of findings; approves major recommendations for resolutions.
  • Prepares comprehensive strategic plans for Civil Rights, Equity, Regulatory program needs in support of SFMTAs overall goals and objectives.
  • Serves as SFMTA liaison officer for equity programs.
  • Stays abreast of new regulations/laws related to Civil Rights, Equity, Regulatory matters; ensures that agency adheres to all federal, state and local regulations; evaluates their impact on agency operations.
  • Advises management of pertinent and timely regulations/laws/developments; makes recommendations on the appropriate agency actions; provides regulatory guidance as needed.
  • Conducts and manages a variety of organizational, operational and analytical studies and investigations; recommends modifications to existing programs, policies and procedures as appropriate.
  • Manages labor issues and grievances; may prepare and handle grievance hearings and related matters; may direct negotiations with the Union on labor issues.
  • Coordinates, compiles and prepares correspondence, reports and documents including recommendations to the SFMTA Board of Directors; reviews finished materials for completeness, accuracy and compliance with federal requirements, policies and procedures; ensures that reports and correspondence are submitted in a timely manner.
  • Manages and participates in the development and administration of the division/section/unit budget; approves the forecast of funds needed for staffing, equipment, materials and supplies; approves expenditures and implements budgetary adjustments as appropriate and necessary.
  • Complies with mandatory audits for the various units.
  • Reviews completed performance audit/investigative reports for content and compliance with policies and procedures.
  • Represents the Office of Civil Rights/Regulatory Affairs & Audits/Administrative Hearings at various meetings including but not limited to the following: SFMTA Board, Board of Supervisors, City departments, elected officials, outside agencies and community groups.
  • Provides assistance to the SFMTAs Director of Administration; prepares and presents reports and other necessary correspondence.
  • Explains, justifies and defends programs, policies and activities in assigned areas of responsibility.
  • Directs and ensures timely response to Sunshine, legislative, media and community requests; negotiates and resolves difficult, sensitive and/or controversial issues.
  • Handles highly confidential information.
  • Selects, trains, motivates and evaluates assigned personnel; provides or coordinates staff training; works with employees to correct deficiencies; implements discipline and termination procedures.
  • Performs other duties as assigned.

THE IDEAL CANDIDATE:

The ideal candidate is a results-oriented professional with proven experience in Civil Rights, Equity, and Regulatory programs. The candidate should have knowledge of the theories, principles, and practices of applicable federal, state, and local rules and regulations governing civil rights for a public agency.

The candidate needs to communicate clearly and concisely, both orally and in writing. The candidate needs to excel at building effective working relationships with leadership, peers, and staff across the agency, and City departments in a manner that advances both Agency and City priorities.

Candidates should demonstrate exceptional long-term planning and execution skills with the ability to prioritize competing needs under potential resource and delivery timeline constraints. The ideal Candidate needs to promote and advance the Agencys mission, vision, values and goals.

A successful candidate will value staff development, foster team cohesion, and promote performance accountability. Emotional intelligence, collaboration skills, and the ability to work effectively with the SFMTAs diverse staff and San Franciscos diverse demographics are critical for success in this role. Additionally, the ideal candidate should have experience working with SF community-based organizations.

Qualifications

MINIMUM QUALIFICATIONS:

  • Possession of a bachelor's degree from an accredited college or university; AND
  • Ten (10) years of full-time professional verifiable experience in Civil Rights, Equity, Compliance management or a closely related field, which must have included eight (8) years of management-level experience.

Education Substitution:

Additional years of the required experience in professional-level contracts and/or procurement work may be substituted for the required education in Minimum Qualifications on a year-for-year basis.
